Terms of Trade
About these terms
These Terms of Trade govern the relationship between McCahon Trading Pty Ltd trading as Integrity Stone (ABN 73 625 826 360) (‘Integrity Stone’, ‘we’, ‘us’) and the client named in the relevant quotation (‘Client’, ‘you’).
By accepting a quotation from Integrity Stone, whether in writing, by payment of a deposit, or by instructing us to proceed, you agree to be bound by these terms in full.
Nothing in these terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (ACL) or any other applicable legislation that cannot be lawfully excluded.
- Definitions
In these terms, unless the context requires otherwise:
- “Integrity Stone” refers to McCahon Trading Pty Ltd trading as “Integrity Stone” (ABN 73 625 826 360).
- “Client” refers to the individual, company, or entity named in the quotation.
- “Works” refers to the templating, fabrication, supply, and/or installation of stone surfaces described in the quotation.
- “Materials” refers to any natural stone, engineered stone, porcelain, or associated products supplied as part of the Works.
- “Site measure” or “template” refers to the on-site visit by Integrity Stone to take precise measurements prior to fabrication.

- “GST” means Goods and Services Tax as defined under A New Tax System (Goods and Services Tax) Act 1999 (Cth).
- Quotations & pricing
- All quotations are valid for thirty (30) days from the date of issue, unless otherwise stated. After this period, prices may be subject to variation.
- Quotations are estimates only until a site measure has been completed and all dimensions confirmed. Final pricing is based on actual site measurements.
- All prices are in Australian dollars and exclude GST unless a separate line item clearly marked “GST Included” appears in the quotation. GST will be added to the invoice total unless otherwise specified.
- Pricing is based on current supplier rates, material availability, and slab characteristics at the time of quoting. Integrity Stone will notify the Client if material pricing or availability changes materially before fabrication commences.
- Quotes are based on suitable ground-floor access. Where mechanical lifting equipment (crane, hoist, or similar) is required due to access limitations, all associated costs are the responsibility of the Client and are not included in the quotation.
- Integrity Stone reserves the right to decline or refuse any works at its discretion.
- Once the Client has confirmed their stone selection and Integrity Stone has collected the material from the supplier, a variation fee of $300 applies for any change to the stone selection. If the material cannot be returned to the supplier, the Client is liable for the full cost of the collected material.
- Scope of works
3.1 What is included
Unless otherwise specified in the quotation, the Works include manufacture, supply, and installation of stone bench tops only. Each quotation includes:
- One (1) site measure / template visit
- One (1) installation visit
3.2 What is not included
Integrity Stone is a stone fabrication and installation business only. We are not carpenters, cabinet makers, plumbers, electricians, or gas fitters, and we will not perform any work outside our scope of expertise regardless of request. The following are excluded from the Works unless explicitly quoted:
- Plumbing, electrical, or gas fitting works
- Drop-in, vessel, or semi-recessed sink installation
- Tiling, painting, or caulking
- Demolition or removal of existing bench tops
- Cabinetry adjustments, structural fixes, or substrate preparation
- Mechanical securing of sinks, hot plates, or tap fittings
- Crane or mechanical lifting equipment hire
- Under-mount sink cut-outs, aprons, gables, or splashbacks (unless specified)
- Stone sealing — this is available as a separately quoted optional extra.
- Payment terms
4.1 Payment schedule
Payment is required as follows:
- 5% Deposit — due to secure a position in the production schedule
- 45% Progress Payment — due to secure a site measure. Site measure will not take place and no materials will be ordered until received
- 40% Progress Payment — due two (2) days prior to installation
- 10% Final Payment — due upon completion of installation
Payment is accepted by bank transfer (EFT) only. Account details are provided on each invoice. Integrity Stone does not accept credit card payments. The 45% progress payment must be received at least two (2) business days prior to the scheduled site measure. The 40% progress payment must be received at least two (2) business days prior to the scheduled installation date. Delayed or outstanding payments may result in the rescheduling of the site measure or installation to the next available date in the production schedule. Integrity Stone is not responsible for project delays due to late payment.
4.2 Late payment
Where payment is not received by the due date:
- A late payment fee of 10% of the outstanding amount will be applied to accounts overdue by more than 14 days after the due date.
- Integrity Stone reserves the right to suspend or reschedule works where payments are overdue.
- Integrity Stone reserves the right to refer overdue accounts to a collection agency. The Client will be liable for all costs associated with debt recovery, including collection agency commission, legal fees, and any court costs.
- Ownership of materials
All bench tops and Materials supplied by Integrity Stone remain the property of Integrity Stone until the Client has paid all amounts owing in full. If the Client fails to make payment in full, Integrity Stone reserves the right to pursue debt recovery through a third party collection agency or through QCAT.
- Lead Times
Lead times for jobs will be confirmed following site measure and are subject to change once manufacturing has commenced.
Due to the nature of natural stone, some material may require additional work during fabrication, which can extend the time required. Given the natural variation in stone composition, we are often unable to confirm a final lead time until production is underway.
As we are committed to delivering the best possible finish on every job, additional time in fabrication may be required to maintain our quality standard.
- Site measure & site readiness
7.1 Site readiness requirements
To carry out an accurate site measure, the following must be complete and in their final fixed position at the time of our visit:
- All cabinetry fully installed, level, structurally sound, and secured in its final position
- All sinks, appliances, and fixtures requiring cut-outs must be on site and available for measurement
- Wall surfaces and structural features affecting the stone installation must be complete
- Safe and clear access to the installation area, free of trip hazards and obstructions
- At least 5 business days’ written notice must be provided when the site is ready for the template visit
7.2 Additional visits
Each quotation includes one (1) site measure visit. The following incur an additional fee:
- Re-attend visit where the site was not ready at the time of the scheduled measure
- Additional site measure visits beyond the one included in the quotation
- Re-attendance for installation where the site is not ready on the scheduled installation date
Additional site measure visits are charged at $350–$550 + GST per visit based on distance from our Nerang workshop.
7.3 Supplied measurements
Integrity Stone does not accept measurements supplied by the Client, their builder, cabinet maker, or any other third party. All measurements must be taken by an Integrity Stone representative during a scheduled site measure. This policy exists to protect both parties and to ensure the accuracy of your finished stone surfaces. If the site is not ready at the time of the scheduled site measure, the options set out in clause 6.2 apply. Fabrication will not commence until Integrity Stone has completed its own site measure.
7.4 Post-measure alterations
Once a site measure has been completed, the dimensions and layout taken on that date are the basis for fabrication. The Client must not move, adjust, or modify cabinetry or any fixtures after the site measure has been completed. Any alterations to the site — including moving, replacing, or adjusting cabinetry or fixtures — may render the site measure inaccurate and will require a new site measure at the applicable re-attend fee before fabrication can proceed. Any on-site work required by Integrity Stone to cut, adjust, refit, or rectify stone as a result of cabinetry or site changes made after the site measure is charged at $350 per hour + GST with a minimum charge of one (1) hour, added to the final invoice. Additional charges may also apply for any of the following:
- Additional power point or appliance cut-outs not identified at the time of measure
- Trimming or adjustments required because cabinetry was altered after the measure
- Additional tap holes or sink positions added or changed after measure
- Any other dimensional change caused by site modifications made after the measure visit
On-site work required to address post-measure alterations is charged at $350 per hour + GST with a minimum charge of one (1) hour. Integrity Stone will notify the Client of the applicable additional charge before proceeding with variations where practicable.
- Natural stone & material variation
Natural stone is a product of nature. Every slab is unique and variation in colour, veining, pattern, texture, porosity, and surface characteristics is inherent to the material. These variations are not defects.
- Slabs may contain natural fissures, pitting, resin fills, and movement. Integrity Stone will make all reasonable efforts to minimise visible fractures and reinforce any natural fissures with epoxy resin where appropriate, but is not responsible for natural fractures existing in the stone prior to or during fabrication.
- Colour, veining, and pattern will vary between slabs and may differ from samples, photographs, showroom displays, or previous projects. Lighting conditions also affect appearance.
- Engineered stone may vary in colour between batches. Integrity Stone will make reasonable efforts to source matching material but accepts no liability for batch variation in manufactured stone products.
- Large format porcelain products are manufactured to specified tolerances but minor variation between batches may occur.
- Any slab layout, book-match, or grain-match images or renders provided during quoting, design, or fabrication are indicative only and are intended to give a general impression of colour, pattern, and grain direction. These images are not a guarantee of the final appearance of the installed stone. Variation may occur between the image and the finished product due to differences in lighting, screen or print calibration, cutting tolerances, and the natural, unpredictable characteristics of the material. Final grain and pattern match is assessed and confirmed by Integrity Stone at the time of fabrication, based on the actual slab(s) selected.
- The Client is responsible for inspecting the installed stone immediately following installation and raising any concerns with Integrity Stone in writing within 48 hours. Concerns raised after this period that could have been identified at inspection may not be covered under the workmanship warranty.
- Seam placement
On longer stone runs, joins or seams will be required. Seam placement is determined by Integrity Stone based on:
- Slab dimensions and material characteristics
- Structural and weight requirements
- Access and transport limitations
- Fabrication best practice
While Integrity Stone will endeavour to place seams in positions that minimise their visual prominence, seam placement is at the discretion of Integrity Stone. Vein matching across seams will be attempted where practicable but is not guaranteed unless specifically included in the quotation.
Any preferences regarding seam placement must be communicated in writing before fabrication commences. Seam placement is not grounds for rejection, rework, or refund once fabrication has commenced.
- Silica dust — health & safety disclosure
Stone fabrication and installation activities — including cutting, grinding, drilling, and polishing — generate respirable crystalline silica (RCS) dust. Prolonged exposure to silica dust is a serious health risk and can cause silicosis, an irreversible and incurable lung disease.
Integrity Stone takes all reasonable precautions in our workshop and on site to control silica dust exposure, including wet suppression methods and powered air-purifying respirators (PAPRs) for all production staff, in compliance with Safe Work Australia silica dust guidelines.
- The Client must ensure the installation area is adequately ventilated during on-site works.
- The Client and all occupants must vacate the installation area while stone cutting, grinding, or fitting is in progress.
- Integrity Stone staff may request that doors and windows be opened or that additional ventilation be provided before commencing on-site work. This request must be complied with promptly.
- Integrity Stone accepts no liability for dust exposure to any person who remains in the installation area contrary to these requirements.
- Installation
- Installation dates are estimates and may change due to supplier delays, material availability, weather, or site readiness.
- The Client is responsible for ensuring safe, clear, and unobstructed access to the installation area, including a clear path from the vehicle access point to the installation area that is free of trip hazards and obstructions. All pets must be secured away from the work area for the duration of the visit. Children must not be present in the work area while installation is in progress. The Client and all other occupants must vacate the installation area while Integrity Stone staff are working. Our team may ask you to clear the area and this request must be complied with promptly.
- Heavy stone requires adequate structural support from cabinetry. The Client is responsible for ensuring cabinets and substrates are fit for purpose and capable of bearing the load of the stone. Integrity Stone is not responsible for damage caused by inadequate structural support.
- Integrity Stone is not responsible for damage to unprotected cabinetry, walls, tiles, floors, appliances, or fixtures on site during installation unless caused directly by the negligence of Integrity Stone staff.
- Plumbing, electrical, gas fitting, and caulking must be completed by licensed trades after installation. These works are not part of the Integrity Stone scope unless specifically quoted.
- Integrity Stone reserves the right to stop work immediately and reschedule where site conditions are deemed unsafe, unsuitable, or where access is insufficient, without penalty or liability. This includes situations where the site is not clear, access is obstructed, or where the presence of other trades or occupants creates an unsafe working environment. Where work is stopped for safety reasons, a re-attend fee will apply to the subsequent visit.
- Where installation cannot proceed because the site is not ready on the scheduled date, a re-attend fee applies and the job will be rescheduled to the next available production date.
- Stone sealing
Quotes provided by Integrity Stone do not include stone sealing unless it is explicitly listed as a separate line item on the invoice. Stone sealing is available as an optional service on request and will always be clearly itemised where included in a quotation.
Where sealing is not included in the quotation, natural stone bench tops will be supplied unsealed. Sealing is strongly recommended to protect stone surfaces against staining, and it is the Client’s responsibility to arrange this independently. Integrity Stone recommends engaging a qualified, professional, licensed stone sealing service following installation and can recommend services on request.
Regardless of whether sealing has been applied, Integrity Stone does not provide any warranty against staining, etching, scratching, chipping, heat damage, chemical damage, or impact damage to stone surfaces post-installation. The ongoing care and maintenance of all stone surfaces is the sole responsibility of the Client. Integrity Stone recommends the use of pH-neutral cleaning products and periodic re-sealing as required to maintain the surface.
- Variations & additional charges
All variations to the original scope of works must be approved in writing by both parties before work proceeds. Additional charges may apply for:
- Site not ready at the time of a scheduled measure or installation visit
- Re-attendance required due to other trades, access restrictions, or site conditions not caused by Integrity Stone
- Reworks or modifications requested by the Client after fabrication has commenced
- Structural issues or site deficiencies discovered during installation
- Incorrect or incomplete information provided at the quoting stage that affects the scope or cost of the Works
- Changes to stone selection after material has been collected from the supplier — a $300 variation fee applies
On-site remedial work not caused by Integrity Stone — including adjustments required due to incorrect or changed measurements, altered cabinetry, or site conditions not identified at the time of measure — is charged at $350 per hour + GST with a minimum charge of one (1) hour.
- Cancellations & changes after fabrication commences
- Deposits are non-refundable once materials have been ordered from suppliers.
- If the Client cancels the Works after fabrication has commenced, the Client is liable for all costs incurred to the date of cancellation, including the cost of any materials already cut or fabricated, site measure fees, and labour performed.
- If stone has been collected from the supplier and the job is cancelled, the Client is liable for the full cost of that material. Where the supplier accepts a return, any applicable restocking or return fees are the Client’s responsibility.
- Once fabrication has commenced, any change to dimensions, layout, or specification is treated as a variation. The Client is liable for the cost of any material already cut to the original specification.
- Where fabricated stone is stored at Integrity Stone’s premises for more than 14 days because the site is not ready, a storage fee may apply.
- Warranty
15.1 Workmanship warranty
Integrity Stone provides a twelve (12) month workmanship warranty from the date of installation on the quality of our fabrication and installation work. This warranty covers defects in workmanship that are attributable to Integrity Stone.
15.2 Material warranty
Integrity Stone does not provide a warranty on the stone material itself. The following apply:
- Natural stone — no manufacturer warranty is available. Natural characteristics including fissures, pitting, and variation are not covered.
- Engineered stone — warranty is provided by the stone manufacturer. The Client is responsible for registering their warranty directly with the manufacturer or supplier.
- Porcelain — warranty (if any) is provided by the manufacturer in accordance with their product terms.
15.3 What is not covered
The following are not covered under the Integrity Stone workmanship warranty:
- Staining, etching, scratching, or surface wear
- Heat damage from pots, pans, or other heat sources
- Chemical damage from inappropriate cleaning products
- Impact damage or chipping
- Damage caused by structural movement in cabinetry or the building
- Any damage caused by other trades after installation
- Damage caused by misuse or failure to follow care instructions
- Issues arising from supplied measurements being incorrect
15.4 Australian Consumer Law
|
Your statutory rights are not affected Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law or any other applicable legislation that cannot be lawfully excluded, restricted, or modified. If you are a consumer under the ACL, you may have additional rights that apply regardless of these terms. |
- Client delays
Where the Client causes a delay to the fabrication or installation schedule, Integrity Stone reserves the right to reschedule the Works to the next available production date. Delays caused by the Client include:
- Site not ready at the time of a scheduled site measure or installation
- Failure to provide required information, confirmation, or approvals in a timely manner
- Failure to make staged payments on time resulting in the suspension of works
- Significant changes to scope or specifications after fabrication has commenced
On-site waiting time beyond 30 minutes where the site is not accessible or ready will be charged at $350 per hour + GST, added to the final invoice.
- Offcuts
Quotes are based on the fabrication of the supplied measurements only and do not include the fabrication, finishing, or supply of any offcuts. Natural stone fabrication involves material wastage as a normal part of the process — slabs are cut to achieve the best possible finish, including grain and pattern match, avoidance of natural imperfections, and clearance for saw cuts and manufacturing tolerances. As a result, remaining material may appear larger than it is, but is frequently unusable due to size, shape, cracking, or imperfections, and its presence does not imply it is available as a usable offcut. All offcuts remain the property of Integrity Stone. Where usable offcuts are available, they may be purchased separately — enquire at the time of quoting. Delivery or transport of offcuts may incur an additional charge.
- Limitation of liability
To the maximum extent permitted by law:
- Integrity Stone’s total liability to the Client for any claim arising from or in connection with the Works is limited to the total value of the quotation or invoice for the relevant job.
- Integrity Stone is not liable for any indirect, consequential, or economic loss, including delays to a building or renovation project, costs incurred by other trades, loss of use of property, or any other consequential loss.
- Risk in the Materials passes to the Client upon completion of installation or delivery, whichever occurs first.
- Integrity Stone is not liable for pre-existing damage to cabinetry, walls, tiles, floors, or any part of the premises, or for damage caused by other trades before or after installation.
- Dispute resolution
- Any concerns must be submitted to Integrity Stone in writing with supporting photographs within 48 hours of the issue being identified.
- Both parties agree to attempt resolution in good faith before escalating to any formal process.
- Consumer and trader disputes up to $25,000 may be resolved through the Queensland Civil and Administrative Tribunal (QCAT) without legal representation. Information on making an application is available at qcat.qld.gov.au. For disputes involving building and construction matters, QCAT or the Queensland Building and Construction Commission (QBCC) may have jurisdiction depending on the nature of the dispute.
- These terms are governed by the laws of Queensland, Australia.
- Privacy & photography
- Client information is collected and used solely for the purposes of administering the Works and complying with legal obligations.
- Integrity Stone maintains the right to photograph completed projects and use those images on our website, social media, and in marketing materials, unless the Client explicitly requests otherwise in writing prior to installation.
- Photographs used for marketing purposes will not include street addresses, letterboxes, or other material that identifies the Client’s property location, nor images of family members or occupants, without the Client’s express written consent.
- General
- These Terms of Trade constitute the entire agreement between Integrity Stone and the Client in relation to the Works, and supersede all prior representations, negotiations, and understandings.
- If any provision of these terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
- Force majeure. Integrity Stone is not in breach of these terms and is not liable for any failure or delay in performance caused by circumstances beyond Integrity Stone’s reasonable control, including supplier delays, material unavailability, extreme weather events, port or freight disruptions, or any other event outside Integrity Stone’s control. Integrity Stone will notify the Client as soon as practicable and make all reasonable efforts to minimise any resulting delay.
- Integrity Stone reserves the right to update these terms at any time. The version in force at the time the quotation was accepted applies to that engagement.
